Expanding Missouri “Castle Doctrine” | HB 122

Missouri House Bill 122 states that an individual who is occupying private property under the authority of the property owner is permitted to use deadly force in specified situations. This would expand the Missouri “Castle Doctrine” to include not only include your own residence and vehicle, but any dwelling the person is lawfully remaining in.

One of the key statements in the bill is: “A person does not have a duty to retreat from a dwelling, residence, or vehicle where 32 the person is not unlawfully entering or unlawfully remaining. A person does not have a duty 33 to retreat from private property that is owned or leased by such individual.”
